  1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the website www.caifuproperty.com.au (the “Website”) and any services, programs, memberships, training, content or communications provided by Caifu Property (“Caifu Property”, “we”, “us” or “our”). By accessing the Website, submitting an enquiry, subscribing to our communications, or engaging in any of our services or programs, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not use the Website or engage our services. If you are using the Website or our services on behalf of a company, trust or other entity, you confirm you have authority to bind that entity to these Terms.

  1. About our services

Caifu Property provides property investment strategy, sourcing, acquisition support and portfolio management services, including through membership-based programs such as our Automatic Equity and Done-For-You programs. Our services may include strategic planning sessions, access to off-market and “deals of the week” opportunities, introductions to our professional referral network, and ongoing client and portfolio support.

We are not tied to any particular developer, vendor, real estate agent or geographic location, and act on behalf of our clients in sourcing opportunities. Details of our current programs, fees and offerings are set out on the Website and may be updated from time to time.

  1. Eligibility

Our services are intended for individuals who are 18 years of age or older and who are legally capable of entering into binding contracts under Australian law. By using the Website or engaging our services, you represent that you meet these requirements.

  1. No financial, legal, credit or tax advice

Nothing on the Website, in our marketing materials, or provided as part of our services constitutes financial product advice, legal advice, credit assistance or tax advice. We are not licensed to provide tax advice, and any general commentary on tax, finance or legal matters is provided for general informational purposes only.

You should seek your own independent professional advice; including from a licensed financial adviser, accountant, solicitor and/or mortgage broker; before making any investment, finance, legal or taxation decision. Any information, projection, case study or example provided by us (including regarding potential equity uplift, rental returns or capital growth) is general in nature, is not a guarantee or forecast of future performance, and should not be relied upon as the sole basis for any decision.

  1. Membership programs and fees

Certain services are provided on a paid membership basis (for example, our Automatic Equity program). Membership fees are one-off fees payable at the time you join a program, as advised to you prior to sign-up. Except as required by law or as otherwise expressly agreed by us in writing, membership fees are non-refundable once paid, including where you subsequently decide not to proceed with an acquisition.

We operate a multi-stage enquiry and onboarding process to give you the opportunity to ask questions and make a fully informed decision before committing to a membership. We limit the number of new members accepted each month (currently up to 15) to help ensure adequate access to opportunities for existing clients.

Unless otherwise stated, membership entitles you to access to available acquisition opportunities for 12 months from the date you submit your first Sales Advice on a project. Within that 12-month period you may complete as many acquisitions as you wish without an additional membership fee. After that period, continued access to new opportunities requires renewal of your membership, at our then-current terms and pricing.

We reserve the right to vary program names, structure, fees and inclusions from time to time. The fees and terms that apply to you are those in force, and agreed with you, at the time you join or renew a program.

  1. Acquisition and project-specific fees

Certain projects, including duplex development opportunities, may attract an additional acquisition fee (for example, a duplex acquisition fee, currently $5,000 per duplex acquisition, payable by eligible program clients). Any such fee will be disclosed to you before you are required to commit to a specific project, and becomes payable only once you elect to proceed with that project following your own research and due diligence.

There is no obligation to proceed with any specific project we present. You are free to decline any opportunity presented to you without penalty, other than any membership fee already paid in accordance with section 5.

  1. Property investment risk

Property investment carries risk, and the value of property can go up or down. Past performance — including any average uplift, returns or results referred to on the Website, in testimonials, or in our marketing materials — is not a reliable indicator of future performance and individual results will vary based on your circumstances, the specific property, market conditions and other factors outside our control.

You acknowledge that any decision to acquire, develop, hold or dispose of a property is made at your own discretion and risk, based on your own due diligence and independent professional advice, and not solely in reliance on information or opportunities provided by us.

  1. Third-party professionals and referrals

As part of our services we may introduce you to, or facilitate contact with, third parties in our professional referral network, including mortgage and finance brokers, accountants, solicitors and conveyancers, property developers and vendors, real estate agents, and property managers (together, “Third-Party Professionals”).

Third-Party Professionals operate independently of Caifu Property and are responsible for their own advice, services, conduct and compliance with applicable licensing requirements. We do not guarantee, warrant or accept responsibility for the acts, omissions, advice, fees or services of any Third-Party Professional. Any engagement between you and a Third-Party Professional is a separate arrangement between you and them, on their own terms.

  1. Website use and intellectual property

All content on the Website — including text, graphics, logos, images, videos and training materials — is owned by or licensed to Caifu Property and is protected by Australian and international intellectual property laws. You may view and use this content for your own personal, non-commercial purposes, but may not reproduce, distribute, modify, or create derivative works from it without our prior written consent.

You must not use the Website in any way that is unlawful, fraudulent, or harmful, or that infringes the rights of Caifu Property or any third party, including by attempting to gain unauthorised access to our systems, introducing malicious code, or scraping or harvesting data from the Website without our consent.

  1. Client portal

If you are provided with access to our client portal or third-party platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised use of your account. We may suspend or terminate portal access if we reasonably believe these Terms have been breached.

  1. Testimonials and case studies

Testimonials, case studies, and statistics (including any average results) published on the Website reflect the experiences of specific clients or aggregate data and are provided for illustrative purposes only. They are not a guarantee of the results you will achieve, and individual results will differ.

  1. Confidentiality

Personal, financial and strategic information you share with us is handled in accordance with our Privacy Policy. We ask that you likewise treat as confidential any non-public project, pricing or strategy information we share with you, and not disclose it to third parties without our consent, except to your own professional advisers on a confidential basis.

  1. Limitation of liability

To the maximum extent permitted by law, Caifu Property excludes all warranties, conditions and representations, whether express or implied, in relation to the Website and our services, other than any consumer guarantees that cannot be excluded under the Australian Consumer Law (ACL).

To the maximum extent permitted by law, Caifu Property’s total liability arising out of or in connection with these Terms or our services (whether in contract, tort, under statute or otherwise) is limited, at our option, to resupplying the relevant services or paying the cost of having the services resupplied. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including under the ACL.

To the extent permitted by law, we are not liable for any indirect, special or consequential loss, or for any loss of profits, revenue, or expected equity/capital gain, arising from your use of the Website, our services, or any property acquisition or investment decision.

  1. Indemnity

To the extent permitted by law, you agree to indemnify Caifu Property, its officers, employees and representatives against any loss, damage, cost or expense arising out of your breach of these Terms, your misuse of the Website, or your investment or acquisition decisions.

  1. Termination

We may suspend or terminate your access to the Website, client portal, or membership program if you breach these Terms, engage in fraudulent or unlawful conduct, or if required to comply with law. Termination does not entitle you to a refund of any fees already paid, except as required by law or expressly agreed by us.

You may cease using the Website or elect not to renew your membership at any time; this does not affect fees already payable or paid in accordance with section 5.

  1. Privacy

Our collection, use and disclosure of your personal information is governed by our Privacy Policy, available on the Website, which forms part of these Terms.

  1. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, business practices or legal obligations. Updated Terms will be posted on the Website with a revised “Last reviewed” date and take effect from that date. Your continued use of the Website or our services after changes take effect constitutes acceptance of the updated Terms.

  1. Governing law

These Terms are governed by the specific state(s) and/or territories laws of Australia. You and Caifu Property submit to the non-exclusive jurisdiction of the courts of your state(s) and/or territories and the courts competent to hear appeals from those courts.
